SERVICE AGREEMENT

​

Please review and accept the full terms of the Service Agreement spelt out below before proceeding to use the gym.

​

A       MODIFICATION

​

At any time and without the consent of you, the user, Dungeon and its operating company EthosX LLP (the Company) may unilaterally amend, modify, or change this Agreement in its sole discretion and without any notice or cause. By continuing to use the gym after any amendment, modification, or change, you have agreed to be bound by all such amendments, modifications, and changes. Therefore, please carefully review this Agreement on a regular basis to maintain awareness of all amendments, modifications, and changes.

B        TERMS AND CONDITIONS OF GYM USE

​

1. Dungeon and the Dynamic and Vigor Pods operate as unmanned gyms available for public use, under a collaboration between EthosX LLP and Immortals Pte Ltd which owns and operates The Gym Pod. To ensure a conducive and safe workout environment for everyone, please ensure that you are

  • at least 16 years of age

  • medically fit

  • experienced and familiar with the safe and competent use of the gym equipment

  • familiar with and agree to the conditions stipulated in the Service Agreement below

2. You are responsible and fully liable for any damage to the equipment or gym facility, personal injury, injury to others, damages, penalties, fines, and losses related to your use of the equipment or facility.

3. You shall indemnify the Company from any claims related to the use of the gym.

4. Personal trainers are responsible for ensuring that your clients adhere to the above requirements and the Service Agreement spelt out below.

 

C        BOOKINGS

​

  1. Download the Dungeon Fitness or Gym Pod app and make a one-time registration to create a user account. By creating an account, you agree that the Dungeon/The Gym Pod team may reach out to you via the app, messages or email as part of the normal business operations for the use of the gym.

  2. Upon creating the user account, you can book and make payment for a timeslot to use Dungeon and the Dynamic and Vigor Pods. There will be no refund once a booking has been made.

  3. In the event that you cannot make it for your booking, you can reschedule it up to two hours before your session.

 

D       USE OF GYM

​

  1. You agree to use Dungeon and the Dynamic and Vigor Pods responsibly.

  2. You shall be responsible for ensuring that any individual using Dungeon and the Dynamic and Vigor Pods under your account shall read and comply with this Agreement.

  3. Do not remove anything from the Dungeon and the Dynamic and Vigor Pods. The premises are monitored by CCTV cameras and a police report will be made in the event of unauthorised removal of equipment.

  4. Dress appropriately. Please wear proper workout attire and covered shoes except when kicking the bags.

  5. No eating in the gym. Bottled water is fine.

  6. Keep the Dungeon and the Dynamic and Vigor Pods clean. Please dispose of any trash properly.

  7. Sanitise and wipe down all equipment and return them to their original location after use.

  8. Please ensure that the entry and exit doors are closed properly after you enter/leave the gym.

  9. Contact The Gym Pod support team  (using the app under Profile > Report & Feedback) and local police immediately in the event of theft of equipment or an accident that occurred during the use of the equipment resulting in bodily injury.

E        TAILGATERS AND OVERSTAYERS

​

  1. Tailgaters and overstayers will not be tolerated.

  2. You are not allowed to let anyone enter the gym without a proper booking.

  3. Do not remain in the gym after your session has ended.

F        EQUIPMENT

​

  1. Before using the gym, you must check the equipment. If something is wrong with the equipment, stop using it and file a report immediately via the app (under Profile>Report & Feedback).

  2. Please sanitise and return all equipment to their original position at the end of your time slot.

G       MISCONDUCT

​

  1. Unacceptable and inappropriate behaviours will not be tolerated in Dungeon and the Dynamic and Vigor Pods. These include but are not limited to:

  • Damaging property

  • Stealing of property

  • Security breaches (includes, but is not limited to tampering with CCTV/door locking mechanism, preventing the door from closing and etc.)

  • Harassment of other users (includes, but is not limited to verbal, physical, and sexual harassment)

  • Leaving Dungeon/the Pods in a dirty and/or unsanitary condition

  • Exceeding the number of pax allowed

  • Overstaying a session

H       DISCLAIMER

​

  1. You acknowledge and accept that you use Dungeon and the Dynamic and Vigor Pods at your own risk.

  2. You acknowledge that exercising in the gym may be a hazardous activity that involves risk to the user and others including damages, bodily injury, partial or total disability, paralysis and death to the user or others.

  3. You have full knowledge of said risks and dangers, including such risks, damages and injuries that may arise from the negligence of others and you acknowledge, understand and assume all risk relating to the usage, maintenance, design, use and/or operation of the Dungeon and the Dynamic and Vigor Pods including the equipment.

  4. You will indemnify the Company, our subsidiaries, associate companies, partners and third party providers from any and all claims, demands, disputes, losses, liabilities, debts, liens, charges, penalties, proceedings, causes of action and damages including for personal injury, wrongful death, property damage, and injury to user or to third parties (collectively, “claims”), including any and all claims related to the sole or partial negligence of the Company and unknown or unanticipated claims, which arise from or are related directly or indirectly to this agreement or the rental, maintenance, design, use and/or operation of Dungeon and the Dynamic and Vigor Pods.

  5. In no event will the user claim that Dungeon and the Dynamic and Vigor Pods parties individually or collectively did not adequately train user, or provide user with adequate instructions necessary, to operate Dungeon and the Dynamic and Vigor Pods.

  6. Dungeon will not be responsible for any loss of belongings, injury or mishap that results from your visit to the Dungeon and the Dynamic and Vigor Pods or the use of ancillary facilities like the restrooms.

​I         PENALTIES FOR VIOLATION OF RULES OR MISCONDUCT

​

For security and safety purposes, the premises are monitored by CCTV. The Company reserves the right to issue temporary to lifetime bans to any account due to user misconduct or breaking of rules.

​

To report misconduct or abuse by another user, you can reach out to The Gym Pod via the Facebook and Instagram pages (@TheGymPod), email us at support@thegympod.com, or use the Report & Feedback function in the Dungeon app.

PRIVACY POLICY

​

(1) In using the Dungeon app, web site, Dungeon gym and the Dynamic and Vigor Pods, you agree and consent to the Company using and processing your personal data for the purposes and in the manner as identified hereunder. For the purposes of this agreement, “personal data” means information about you, including photographs and videos, from which you are identifiable.

 

(2) The Company may use and process your personal data for the business and activities of the company which include the following:

  • Process, manage and verify your registration and carry out any other related administrative matters.

  • Provide you with services in relation to the use of Dungeon gym.

  • Validate and/or process payments according to the terms of use.

  • To process any rebates and/or charges that may be applicable.

  • To facilitate or enable any checks that may be required under the terms of use.

  • To respond to questions, comments and feedback from you;

  • To communicate with you on matters related to the use of the gym.

  • For internal administrative purposes, such as auditing, data analysis, database records;

  • To use images/videos taken on the premises for commercial purposes without payment.

  • For purposes of detection, prevention and prosecution of crime;

  • For safety management;

  • For the Company to comply with its obligations under law;

  • To send you alerts, newsletters, updates, mailers, promotional materials, special privileges, festive greetings from the Company, its partners, advertisers and or sponsors;

  • To share your personal data amongst the company’s subsidiaries, associate companies, partners, agents, third party providers, developers, advertisers, partners, event companies or sponsors who may communicate with you for any reasons whatsoever.

By submitting your information to the Company, you consent to the use of that information as set out in this Privacy Policy.

 

(3) Notify us via the Dungeon app (Profile > Report & Feedback) If

  • you do not consent to the Company processing your personal data for any of the purposes mentioned above.

  • any of the personal data that you have provided to us changes, for example, if you change your e-mail address, telephone number, payment details or if you wish to cancel your account. We will, to the best of our ability, effect such changes as requested within fourteen (14) working days of receipt of such notice of change.
